PMA Terms of Service

1. About PMA and These Terms
PMA is an animal husbandry and collection-management service operated under the name Project Mad Adder. These Terms govern access to and use of the PMA application, websites, and related services (the “Service”). By accepting these Terms, you agree to comply with them. If you use PMA on behalf of a business or organization, you confirm that you are authorized to accept these Terms on its behalf. The Service is currently offered as a free beta. Additional terms may apply to future paid plans or optional services, but those terms will be presented separately before they apply.
2. Eligibility and Accounts
PMA is a general-audience service intended for people interested in animal care, breeding, collection management, and related activities. You must be legally permitted to use the Service and, where required, have the authorization of a parent or legal guardian. Children under 13 may not register independently. A parent or guardian who wishes to arrange access for a younger child should contact PMA so that applicable consent and privacy requirements can be addressed. PMA may decline or restrict access where the necessary safeguards are not available. Additional requirements may apply to minors in particular jurisdictions. You agree to provide accurate account information, protect your login credentials, and notify PMA promptly if you suspect unauthorized access. You are responsible for activity conducted through your account, except to the extent caused by PMA’s own breach of its obligations.
3. Free Beta Access
Beta access is provided free of charge and may be subject to registration approval, capacity limits, or other reasonable eligibility requirements. Submitting an application does not guarantee admission. Beta features may be incomplete, contain defects, or change during development. PMA may add, modify, suspend, or discontinue experimental features. We will use reasonable efforts to communicate material changes where appropriate. Beta access will never automatically convert into a paid subscription. PMA will not charge you merely because beta ends. Any future paid subscription will require a separate affirmative purchase decision after the applicable pricing and payment terms have been disclosed.
4. Animal Care and Use of Information
PMA provides tools for recording, organizing, and analyzing animal husbandry and related information. It is not a veterinary practice, emergency-monitoring service, or substitute for qualified professional advice. Species information, care recommendations, genetic probabilities, forecasts, alerts, and automated outputs may be incomplete or inaccurate. You remain responsible for directly observing your animals, maintaining suitable husbandry and equipment, verifying important information, and obtaining qualified veterinary care when necessary. PMA does not guarantee particular breeding, health, financial, or husbandry outcomes. Nothing in these Terms limits responsibilities that cannot lawfully be excluded.
5. Your Data and Ownership
You retain ownership of the animal, husbandry, breeding, business, media, and other records you lawfully submit to PMA (“Customer Data”). You grant PMA a limited, non-exclusive permission to host, store, process, transmit, display, and otherwise use Customer Data as reasonably necessary to provide, maintain, secure, and support the Service and the features you request. PMA does not acquire ownership of your Customer Data merely because it is stored in the Service. We will not sell private Customer Data or use it to train AI models by default. Any future optional use of private Customer Data for AI training would require a separate, informed, affirmative choice. You are responsible for ensuring that you have the necessary rights and permissions to submit information, including personal information about other individuals.
6. Privacy and Security
PMA collects and processes information necessary to administer accounts, provide requested features, store Customer Data, maintain security, communicate with users, and support the Service. More detailed information about collection, service providers, international processing, retention, and privacy rights is provided in PMA’s Privacy Notice. PMA is responsible for maintaining reasonable safeguards appropriate to the sensitivity of the information it processes. No internet-based service can guarantee absolute security. We will investigate suspected security incidents and provide notifications where required by applicable law. You should maintain appropriate independent records of information that is critical to your operations. PMA does not guarantee a particular backup, recovery, encryption, or deletion capability unless it has been expressly documented and made available.
7. Workspaces and Authorized Users
Where PMA permits multiple users to collaborate within a workspace, access is governed by the roles and permissions assigned through the Service. Workspace owners and administrators are responsible for managing authorized membership and ensuring that users have appropriate access. PMA will not intentionally transfer workspace ownership or disclose private workspace records to unauthorized parties. Account closure, workspace deletion, and ownership transfers may require verification and may be subject to applicable legal and security requirements.
8. Acceptable Use
You agree to use PMA lawfully and responsibly. You must not attempt unauthorized access, interfere with the Service, distribute malicious code, compromise another user’s privacy, impersonate another person, or circumvent security or access controls. You must not use PMA to facilitate unlawful wildlife trafficking, animal cruelty, fraud, falsification of regulated records, or other unlawful conduct. You are responsible for complying with laws applicable to your own animal care, possession, breeding, transport, and commercial activities. Supported APIs, integrations, exports, and automation features may be used within their documented limits. Abusive or disruptive automation is prohibited.
9. Availability and Changes
PMA aims to provide a reliable Service, but beta availability is not guaranteed. Maintenance, defects, network failures, third-party outages, and other circumstances may affect access. We may change the Service as it develops. Where practicable, we will provide reasonable notice of material changes that affect users or their records. We will not intentionally delete Customer Data solely because a subscription plan changes.
10. Suspension, Closure, and Data Continuity
PMA may restrict or suspend access where reasonably necessary to address security risks, unlawful conduct, material violations of these Terms, or threats to the Service or other users. Where practicable, we will provide notice and an opportunity to resolve the issue. You may request account closure by contacting PMA or using available account controls. Account closure does not automatically authorize deletion of records belonging to another workspace owner or other authorized users. Data export, deletion, and retention requests will be handled according to applicable law and PMA’s actual operational capabilities. PMA will not promise a specific deletion or recovery timeframe unless that timeframe has been established and verified.
11. Intellectual Property
PMA and its licensors retain ownership of the Service, software, designs, trademarks, documentation, and other proprietary materials, excluding Customer Data. Subject to these Terms, PMA grants you a limited, non-exclusive, non-transferable right to access and use the Service for your authorized purposes. You may not resell, copy, reverse engineer, or exploit the Service except as permitted by law or expressly authorized by PMA.
12. Disclaimers and Liability
To the extent permitted by applicable law, PMA does not guarantee that the Service will be uninterrupted, error-free, or suitable for every particular purpose. You should not rely exclusively on beta software for critical animal-care or business decisions. PMA is not responsible for losses caused by circumstances outside its reasonable control. To the extent permitted by law, PMA excludes liability for indirect, incidental, special, or consequential losses arising from use of the Service. Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any liability or consumer right that cannot lawfully be excluded or limited. These Terms do not prevent you from exercising rights available under applicable law.
13. Changes to These Terms
PMA may update these Terms to reflect changes in the Service, applicable law, or business operations. Material changes will be communicated through the Service or another appropriate channel. Where a new version requires acceptance, PMA will present that version and record the applicable decision. Continued use will not be treated as consent to a materially different purpose where fresh consent is legally required. If you do not agree to a required new version, you may discontinue use and request available data-export or account-closure assistance, subject to applicable legal and security requirements.
14. Governing Law and Disputes
These Terms are governed by the laws of New Brunswick and the applicable federal laws of Canada, subject to mandatory consumer, privacy, and other protections that apply in a user’s jurisdiction. Before commencing formal proceedings, you and PMA are encouraged to contact one another and attempt to resolve disputes in good faith. Nothing in these Terms prevents you from exercising rights before a competent court or regulator where applicable law permits.
